East Coast Sleep Clinic ("we," "us," "our") is committed to protecting your privacy and the confidentiality of your personal and health information. This policy explains what we collect, why we collect it, how we use and protect it, and the rights you have over your information.

We follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and New Brunswick's Personal Health Information Privacy and Access Act (PHIPAA).

1. Who We Are

East Coast Sleep Clinic operates clinics in Kennebecasis Valley, Sussex, and Riverview, New Brunswick, providing home sleep apnea testing, CPAP therapy, CPAP supplies, and patient education. We are a custodian of personal health information under PHIPAA.

2. What We Collect

We only collect information that is reasonably necessary to provide care, run our clinics, and communicate with you.

Through our contact form, we collect your name, email address, phone number, your selected clinic location, and any message you choose to share with us.

Through our STOP-BANG sleep apnea screening tool, we collect your responses to the eight screening questions, which include health-related information such as snoring, daytime fatigue, observed breathing pauses, blood pressure status, body mass index, age, neck circumference, and sex. If you choose to receive your results, we also collect your email address.

Through our referral and patient questionnaire forms (sent to our clinic email addresses), we collect the personal and health information needed to set up your home sleep test, including contact details, health history, symptoms, medications, and your healthcare provider's information.

Through the course of care, we collect clinical information such as sleep study results, CPAP therapy data, equipment records, insurance details, and follow-up notes.

Automatically through our website, our hosting platform may collect basic technical information such as your IP address, browser type, and pages visited. This is used for site security and general analytics, not to identify you personally.

3. Why We Collect It

We use your information to:

  • Respond to your inquiries and schedule appointments
  • Provide your STOP-BANG screening results and recommend next steps
  • Coordinate your sleep test, diagnosis, CPAP therapy, and follow-up care
  • Communicate with your physician, nurse practitioner, or other members of your circle of care
  • Submit insurance claims and direct-bill on your behalf
  • Send appointment reminders, equipment follow-ups, and clinically relevant updates
  • Send educational materials about sleep health, only if you have explicitly opted in
  • Meet our legal, regulatory, and professional obligations

We do not sell your personal information. We do not use your health information for marketing.

4. Consent

By submitting a form on our website or beginning care with us, you consent to us collecting and using your information for the purposes listed above. You may withdraw your consent at any time, subject to legal and clinical record-keeping requirements (for example, we are required to retain medical records for a defined period even after care ends).

For non-clinical communications such as newsletters or educational mailings, we will only contact you if you have given express opt-in consent under Canada's Anti-Spam Legislation (CASL). Every such message includes an unsubscribe link.

5. STOP-BANG Questionnaire — Specific Notice

The STOP-BANG screening tool collects sensitive health information. By entering your email to receive results, you consent to:

  • Receiving your STOP-BANG score and risk assessment by email
  • Storing your responses and email in our secure systems for follow-up

You will not be added to any marketing list unless you separately opt in. You may request deletion of your screening responses at any time by contacting our Privacy Officer.

The STOP-BANG tool is a screening aid. It is not a diagnosis and does not replace a clinical evaluation.

6. Who We Share It With

We share your information only when necessary, and only with:

  • Your healthcare providers (family doctor, nurse practitioner, specialists) as part of your circle of care
  • Sleep medicine physicians who interpret your sleep study
  • Your insurance provider, with your authorization, for billing purposes
  • Service providers who help us operate the clinic (for example, our electronic records system or secure email provider) — these providers are bound by confidentiality agreements
  • Government bodies or regulators when required by law

We do not share your information with third parties for marketing or commercial purposes.

7. Where Your Information Is Stored

We aim to store personal health information on Canadian-hosted systems whenever possible. Some service providers (for example, certain email or website tools) may store data outside of Canada, where it could be subject to the laws of that country. We take reasonable steps to ensure these providers offer comparable protection.

8. How Long We Keep It

Clinical records are retained for the period required by New Brunswick health regulations and our professional obligations (typically a minimum of 10 years from last patient contact, or longer for minors).

Website inquiry information and screening questionnaire responses that do not become part of a clinical record are retained only as long as needed to respond to you or as required by law, and are then deleted. You may request deletion of your information at any time by contacting our Privacy Officer.

9. How We Protect It

We use a combination of physical, technical, and administrative safeguards, including:

  • Locked storage and limited-access offices for paper records
  • Password-protected, role-restricted access to electronic records
  • Encrypted transmission for sensitive communications where available
  • Staff training on PHIPAA and PIPEDA obligations
  • Confidentiality agreements with all staff and contractors

A note about email: Standard email is not fully secure. If you send personal or health information to us by email, please be aware of this risk. For sensitive information, we encourage you to call the clinic or ask us about secure alternatives.

10. Your Rights

Under PHIPAA and PIPEDA, you have the right to:

  • Access the personal information we hold about you
  • Correct information that is inaccurate or incomplete
  • Withdraw consent for future use (subject to legal limits)
  • Request deletion of information that is no longer required
  • File a complaint with our Privacy Officer or with the regulators below

To exercise any of these rights, contact our Privacy Officer. We will respond within 30 days.

11. Breach Notification

If a privacy breach occurs that creates a real risk of significant harm, we will notify affected individuals and the relevant regulators as required under PHIPAA and PIPEDA.

12. Cookies and Website Analytics

Our website may use cookies and basic analytics to understand how visitors use the site. These tools do not identify you personally. You can disable cookies in your browser settings.

13. Changes to This Policy

We may update this policy from time to time. The "last updated" date at the top will reflect any changes. Material changes will be highlighted on our website.
